Akvire is an AI-powered luxury vehicle concierge platform that helps users discover, monitor, and track luxury and exotic vehicles from various marketplaces. The Service provides:
- Vehicle search and filtering capabilities
- Automated matching of user preferences with available listings
- Market data and deal scoring
- Email alerts for matching vehicles (paid tiers)
- Vehicle wishlist management
3. User Responsibilities
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Use the Service only for lawful purposes
- Not attempt to circumvent any security features or access restrictions
- Not use automated tools to scrape or harvest data from the Service
4. Vehicle Listings and Information
Important Disclaimers:
- Third-Party Data: Vehicle listings are aggregated from third-party sources. Akvire does not own, sell, or directly facilitate the sale of vehicles listed on the platform.
- Accuracy: While we strive to provide accurate information, we do not guarantee the accuracy, completeness, or timeliness of vehicle listings, pricing, or availability.
- Prices Subject to Change: All vehicle prices, specifications, and availability are subject to change without notice by the listing sources.
- Market Data: Deal scores and market comparisons are estimates based on available data and should not be considered professional appraisals or financial advice.
5. Subscription and Billing
5.1 Subscription Tiers
Akvire offers the following subscription tiers:
- Free: Limited to 1 wishlist, basic features, no email alerts
- Pro ($14/month): Unlimited wishlists, email alerts, full deal scoring
- Elite ($29/month): All Pro features plus priority matching and dedicated support
5.2 Billing
Subscription fees are billed monthly in advance. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
5.3 Cancellation and Refunds
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- No refunds are provided for partial months or unused portions of your subscription
- We reserve the right to change subscription pricing with 30 days' notice
6. Intellectual Property
The Service, including its design, functionality, and content (excluding third-party vehicle listings), is owned by Akvire and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of the Service
- Reverse engineer or attempt to extract source code
- Remove any proprietary notices or labels
- Use Akvire trademarks without written permission
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR ANY VEHICLE PURCHASES, NEGOTIATIONS, OR TRANSACTIONS
- WE ARE NOT RESPONSIBLE FOR ERRORS OR OMISSIONS IN VEHICLE LISTINGS
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
8. Indemnification
You agree to indemnify and hold harmless Akvire, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any vehicle transactions or disputes
9. Dispute Resolution and Arbitration
9.1 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
9.2 Class Action Waiver
You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
9.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
10. Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abusive behavior toward other users or staff
- Non-payment of subscription fees
Upon termination, your right to use the Service will immediately cease.
11. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or in-app notification.
12. Miscellaneous
12.1 Entire Agreement
These Terms constitute the entire agreement between you and Akvire regarding the Service.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
